Philippines' Duterte tells mining companies to 'shape up'
Philippine President-elect Rodrigo Duterte warned mining companies to "shape up", as he signaled he would prefer ownership of mining assets to be left to local investors. He also said the incoming government may rewrite rules to limit environmental degradation in the sector. Duterte, who assumes office on June 30, has named nearly all his cabinet members this week but has yet to appoint a new minister that will oversee the Southeast Asian country's mining sector. The country has among the largest untapped mineral resources in the region but years of opposition from the Catholic Church and a strong anti-mining lobby, as well as insurgency and widespread corruption, have stalled many projects including the $5.9 billion gold-copper Tampakan project in the southern Mindanao island discovered in 1991. "I have a big problem with mining companies. They are destroying the soil of our country," Duterte told a crowd of more than 100,000 in Davao celebrating his May 9 election victory. "The mining people must shape up. It has to stop. The spoiling of the land, the destroying of Mindanao." Swiss giant Glencore quit the Tampakan project in 2015, with the venture halted by a ban on open-pit mining in Mindanao's South Cotabato province imposed from 2010. A local company has taken over the project. Duterte signaled that ownership of mining companies may be best be left to locals. "I want it to be a cooperative of all Filipinos. We will support them and give them instructions how not to end up spoiling the land, he said.

The Mining Act of 1995 is a long-wrought tragedy for indigenous peoples
The benefits of mining argued by mining corporations as compensatory for its immense social costs and environmental destruction is a lie. Mining corporations in collusion with the government paint a rosy picture of mining, insisting on "responsible mining" and "there is life in mining" yet its impacts on the environment and people, especially to the indigenous peoples, tell a different story. The Mining Act of 1995 is a long-wrought tragedy to indigenous people. It worsens foreign-favored, one sided, anti-people policy of liberalization of the mining industry. It bridges and aggravates the centuries-old foreign plunder of resources in our lands. The Mining Act of 1995 worsens the oppressions against us. As our ancestors did, we have valiantly defended our lands from the transgressions, and today we defend our land and life from liberalized mining. However, we found ourselves pitted against government forces as they play protector of large-scale mines. Deployment of military forces where there are large-scale mining interests are massive. As if the massive deployment of military was not enough, the AFP recruits indigenous peoples to paramilitary groups. Reneging its campaign promise to dissolve paramilitary groups at the aftermath of the Ampatuan massacre, President BS Aquino beefs up the viciousness of its armed forces by allowing the formation of paramilitary groups and use them as pawns in counter-insurgency and as mining security. Under the BS Aquino presidency, 50 indigenous peoples, including 6 indigenous women and 6 indigenous children, were slain by the AFP and paramilitary groups. The violation of human rights of indigenous peoples worsened as a result of mining and militarization. On October 18, 2012, member of the 26th Infantry Battalion strafed the home of Juvy Capion, a Blaan woman and one of the leaders of the Blaan people's fight against the mining operations of SMI-Xstrata in their ancestral lands. The attack on their home killed and 8 months- pregnant Juvy, and her two young sons. Kitari Capion, Datu Anting Freay, and 16-year-old Victor Freay adds to the lists of Blaan people killed by suspected military forces in the SMI-Xstrata mining site between 2012 and 2013. Military operations also caused the forced evacuation of communities. Thousands of indigenous peoples repeatedly evacuated in Surigao del Sur, agusan del Sur, Compostela Valley, and Bukidnon among others. In tandem with violence, the government uses deception to facilatate the entry of mining outfits in ancestral lands. The connivance of the government and mining corporations is best exemplified by the National Commission on Indigenous Peoples (NCIP.) The NCIP is the lead agency in deceiving, manipulating, bribing and dividing indigenous peoples. Instead of upholding IP rights and welfare against business interests, NCIP only negotiated in favor of the latter. The NCIP conducts "consultations" for mining outfits to fulfill the mandated Free Prior Informed Consent of indigenous communities. However, the FPIC process is riddled with issues of corruption, bribery, and coercion; and it has been used to legalize the entry of development projects in ancestral lands. The IPRA neither projects nor defends the rights of indigenous peoples to their lands and self-determination. It is tool of the State, deceptive and lethal, for plunder and exploitations of indigenous people's lands. The Mining Act of 1995, aided by the IPRA and strengthened BS Aquino's very own EO 79 is a deadly combination for the rights of indigenous peoples to their lands and to self-determination. For us indigenous peoples, the BS Aquino administration brings no respite from environmental destruction, human rights violations, repression, and oppressions similar to past regimes. Its continued implementation of the Mining Act of 1995 is a testament to this fact.

'Putting Ourselves in Their Shoes' tells of the rising resentments among community members to the operations of Tintaya mine through the course of its government ownership and subsequent privatization, and the way these came to a head when ownership passed to BHP Billiton. It relates the process by which non-governmental organisations such as Oxfam Australia, Oxfam America, CooperAccion and Corecami entered the picture, and the important roles they played in helping give birth to the process and/or supporting the communities' ability to engage effectively. It relays the concerns of communities and their leaders, the pressures on the company at the time, and how ultimately, all parties agreed upon the creation of a "Dialogue Table" that identified key issues, principles and ground rules for an ongoing dialogue process that continues to this day. It conveys setbacks for both communities and company in the process, and the ultimate achievement of meaningful and sustainable outcomes. This is one of four films in a series on company-community dialogue produced by the Corporate Social Responsibility Initiative at Harvard Kennedy School on behalf of the mandate of the former Special Representative of the UN Secretary-General for Business and Human Rights, Professor John Ruggie. The films were produced with the generous support of the Government of Norway, the Compliance Advisor/Ombudsman of the World Bank Group, the International Bar Association and the Government of Germany. The films are MATCH productions. On November 29, 2012, the series won "best communication or publication" award at the biennial Centre for Effective Dispute Resolutions (CEDR) awards ceremony held in London. The series makes a compelling case for Alternative Dispute Resolution (ADR) methods and processes, using real life corporate-community case studies to show the immediate and long term benefits of facilitated dialogue.

Next Gen's GreenRush helps investors learn 'the ropes' of the fast growing cannabis sector
June 19, 2014 -- Tracy Weslosky, Editor-in-Chief and Publisher of InvestorIntel speaks to Harry Barr, the President, CEO and Director for Next Gen Metals ('Next Gen', CNSX: N) about its subsidiary GreenRush Financial Conferences (GreenRush) and the great potential of the marijuana, alternative medicine and industrial hemp sector (cannabis sector for short here). Harry has a broad public markets background -- he raised a quarter of a billion dollars in various projects all over the world. The first GreenRush conference was held last May 7 in Vancouver and a second conference will be held on June 26 in Toronto. Harry tells Tracy that he has become involved with the emerging market for medical marijuana and related industries because "the last couple years have been very difficult for the junior miners; so we decided to take one out and, to make a long story short, my family has been into farming since 1866; I studied agribusiness at the University of Guelph and followed that industry all my life." Harry explains that GreenRush is the "hub and platform for education and finance" in the cannabis sector. The Vancouver event was a great success, or as Tracy says "a stampede of investors'. Harry expects the Toronto event to be no less a success. The booths have been almost sold out and only a few spaces left -- at the time of writing - while speaking slots are full. Harry mentions some notable presenters and he starts with Jody Emery, "whose husband was unfortunately put in jail for five years and he is like a 'Mandela' for the marijuana business." The important consideration in the cannabis sector is that it's a brand new business with new laws. Medical doctors are becoming increasingly interested -- and some will be speaking at the event -- as are consultants in such 'conservative' business outfits as Deloitte, which will also be formally attending and presenting at the Toronto GreenRush. Lawyers will be there to help explain the new legal implications in cannabis along with all the main players in the industry, who are now running companies and others who simply prefer to use marijuana based ailments rather than the more widely prescribed chemical varieties. In short, GreenRush will offer a great educational opportunity. Harry also talks about hemp, which is the world's strongest fiber and which was legalized in Canada in 1998. It remains illegal in the United States, but it has been gathering strong interest around the world, also because of its nutritional qualities; in fact, Harry says "it can feed the world!" Harry also says that hemp can be used as a construction material when mixed with water and lime. By buying shares in Next Gen, investors have a general market access to the sector as a whole. Pregnant Blaan woman and two kids massacred during military operation of 27th IB -- Karapatan
"It was a massacre and not an encounter," said Cristina Palabay, secretary general of Karapatan belying claims of Lt. Col. Alexis Bravo, head of the 27th IB of the Philippine Army that a Blaan woman, Juvy Capion, 27, and her two sons, John , 8, and Pop, 13 were killed in a gunfight. Initial reports that reached the Karapatan national office indicated that on October 17, Juvy Capion, daughter Vicky, 5, and her two sons went to their farm and spent the night in Fayahlob, Sitio Datal-Ayong, Bgy. Danlag, Tampakan, South Cotabato because they did not finish their day's work. The following day, On October 18, at around 6 a.m., the four were still inside the hut when elements of the 27th IB arrived, and sprayed bullets on the hut, killing Juvy Capion and her two sons. Vicky was wounded. "There was no gunfight between the military and Juvy's husband Dagil as the military claimed. This lie is being peddled to justify the killings and exonerate the military officials and personnel from accountability," said Palabay. The military said that Dagil Capion, a B'laan tribal leader, has taken up arms against the Xstrata- Sagittarius Mines, Inc. (SMI). At the time of the incident, Dagil, who is said to be the military's target, was working on their farm. He was also wounded but managed to escape. After the massacre, the bodies of Vicky and her two sons were laid out on the ground and left exposed to the elements for eight hours, until 3 p.m., reportedly to force Dagil to surrender. Later, the soldiers allowed Capion's relatives to bring home the remains. Juvy Capion was a member of Kalgad, an organization of the Blaan tribe that is opposed to the entry of Xstrata-Sagittarius Mines, Inc (SMI) as there are about 30,000 Blaan who will be displaced from their ancestral lands with the entry and operation of Xstrata-SMI. SMI is touted to be the biggest mining investor in the country with U$5.9 billion investment largely in Tampakan, South Cotabato. The SMI is owned by the Australia-based Xstrata Copper, believed to the the fourth largest global copper producer. "We call on Pres. Noynoy Aquino to order the complete pullout of the 27th IB and other paramilitary groups from the Lumad communities. The military and paramilitary forces serve as company guards and they have harassed, threatened and intimidated the Lumad who are opposed to the SMI operation," said Palabay. The 27th IB is based in Tupi, South Cotabato while the paramilitary groups, specifically the Special Armed Auxilliary has a mandate from the Malacañang as they are force multipliers in the protection and security of mining companies such as the SMI. Palabay said that Karapatan is "alarmed with the spate of killings among the indigenous peoples who, naturally and logically, oppose the operation of foreign-owned, large-scale mining corporations, as these operations are in their ancestral lands, depriving them of their source of livelihood, and therefore, their life and desecrating their culture."
